Arbitration Approach:
Varies depending on the case but prefer the non-caucusing approach so that all participants have the same information and the parties feel that they are the center of the mediation. I start by listening but will be evaluative if the mediation stalls.
Briefs & Other:
Mediation brief (in either pleading or letter format) seven days prior to mediation date. Should list the issues in dispute and the party's contentions re those issues should discuss history of settlement talks and mention applicable law re out-of-the-ordinary issues or contentions. Fee Information:
$400 per hour
My rate per day is $3000; my rate per half day is $1500. Payment will be required prior to the mediation session.
