I let the parties have their day and express what they have experienced and are continuing to experience from the litigated matter. I try to guide them on where I think the fair resolution is but also what is good for the parties. When necessary, especially with counsel, I can give views on what I think will happen based on experience and what the risks are. With the parties, I try to focus on what will help them move forward and feel vindicated but what will also help close the matter. There is a balance between risk and reward in litigation that needs to be evaluated; but, I try to help the parties feel as though they have achieved that equilibrium on their own.
Ideally parties will send a brief with relevant evidence 3 days beforehand. Longer is not always better and basic law on the matter is not necessary. The only law usually needed is for unusual issues that may be relevant to the case. Generally, evidence and testimony provide the most help.
Rate Per Hour: $625
Rate Per Half Day: $3000
Rate Per Day: $5000
On private mediations, I would normally charge higher.
