I have served as a neutral since 2011 to the present time.  I have mediated a few hundred civil cases. I have rendered my mediation services as part of my pro bono services to the public to resolve limited civil cases, small claims, unlawful detainer, and civil harassment under the court-annexed programs in Orange County. I have also mediated unlimited and complex civil cases as a private neutral.  I have served as an adjunct professor at Trinity Law School in Santa Ana since 2013 to the present time. I am responsible for:
Teaching students ADR(Alternative Dispute Resolution) laws and practice as a problem-solving and peacemaking tool; Training students  to act as third-party neutrals to help the disputants to facilitate a resolution of their conflicts before or after the lawsuit filed; Establishing an on-campus Mediation Clinic;  Coordinating with various stakeholders such as Orange County Superior Court, Community Service Program and Orange County Human Relations to implement the court-connected mediation clinic; and  Supervising a selective group of students to mediate the real lawsuits at the court sites.

My Mediation Work Style

The mediator("Mr. Kim") uses a facilitative style of mediation.  With  40 years of  experience in all areas of civil law in cross-cultural and multi-national forums, the mediator will oftentimes draw upon his deep professional history to assess the best way to resolve the dispute.  

The parties are initially separated into separate conference rooms.  Upon further discussion with counsels, the mediator may elect to ask the parties or the attorneys to come together in a joint session or to privately caucus with the attorney of the client.  The parties should expect that the mediator will spend about half of the mediation session in the other room with your opposing side in an effort to further understand the dispute or to further promote your position to the other side.

All discussions between the mediator and the parties/counsels are confidential and protected.

Counsels are requested to bring all decision-makers to the mediation hearing to maximize their chances of settlement.

Demonstrative evidence is generally not necessary for mediation, but counsels are welcomed to bring them should they feel that it will be helpful in facilitating a negotiated settlement.

If the occasion unfolds that the parties are not able to resolve their dispute at the mediation, then the mediator will make subsequent and periodic follow-up calls with the parties to further aid the negotiation.

Counsels are asked to include a contact number or email address should the mediator need to contact counsels before the mediation with questions.

Mediation briefs are kept confidential by default. However, counsels can elect to exchange mediation briefs with each other should they desire.  Alternatively, counsels may also submit a confidential brief to the mediator and exchange a separate letter/brief amongst each other.

The mediator will allow counsels to brief him according to counsel’s best assessment of their case.  Should counsel feel that including specific exhibits that will further aid the mediator in his understanding of the issues or ability to negotiate a settlement, then counsels are asked to do so. 







Fee Information:

Rate Per Hour: $700

Rate Per Half Day: $3500

Rate Per Day: $7000

Fee Deposit Policy(2023)

1. RATES- $700 per hour 
HALF DAY(5 hours)- $3,500 includes 4 hours of mediation conference time and up to 1 hour of mediation brief review and preparation time
Full DAY(10 hours) – $7,000 includes 8 hours of mediation conference time and up to 2 hours of mediation briefs review and preparation time and pre-mediation conference
 Fees for “unused” time will not be refunded.  Mr. Kim does not charge any fee for case administration.

2. EXTRA SERVICES – Mr. Kim reserves the right to charge for extra preparation, conference, and follow-up time at the rate of $700 per hour. Mr. Kim may charge additional fees for travel outside of Orange and Riverside, Los Angeles counties. Mr. Kim reserves the right to charge additional fees for cases involving more than 2 parties who are separately represented or particularly complex issues. 

3. THIRD PARTY FACILITY COSTS/IN-PERSON MEDIATIONS OUTSIDE OF ORANGE COUNTY AREA – Mr. Kim will provide all mediation sessions via Zoom videoconference unless the parties agree otherwise. For in-person mediations outside of Orange County area, the conference facilities need to be arranged by the parties and will be subject to a full day rate.  Should a third-party facility become necessary, Mr. Kim can assist in securing conference space and the cost will be the responsibility of the parties.

4. DEPOSITS – Mediation fees are due in full upon booking. We reserve the right to take matters off calendar if fees are not paid. Each participant’s share of the total amount due must be received 30 days before the mediation to guarantee the mediation date and time.  Invoices are due upon receipt and no later than 30 days prior to mediation date.

5. PAYMENT RESPONSIBILITY/INSTRUCTION
The attorneys and their clients are jointly and severally responsible for payment of fees and costs.  The fees and costs will be billed to and are due from the mediation participants in equal, pro rata shares unless the parties agree to a different allocation and notify Mr. Kim before the time of billing. Payment may be made by check, wire transfer or credit card. If fees are not paid seven days prior to mediation, fees must be paid by wire transfer or credit card.

6. CANCELLATION/REFUND – Please do not reserve a mediation date unless you are sure that you will go forward. Mr. Kim will refund mediation fees paid less $700   when the parties cancel in writing 30 days or more in advance of the scheduled date. If the parties cancel less than 30 days before the scheduled date, Mr. Kim will refund fees only if he can fill the date with another matter.
