My mediation style tends to be more facilitative at the outset, asking questions to understand the needs of each party. This process often opens the door to a more collaborative and creative spirit of negotiations. Depending on the stage of the mediation, I am equally able to shift to an evaluative approach, drawing on my extensive trial experience to provide parties with a realistic assessment of the case. Overall, I find the most effective approach to mediation is a fluid and balanced combination of both facilitative and direct/evaluative styles depending on the nature of the case, the temperament or experience of the parties, the stage of the mediation and the subject matter of the dispute.
To the extent possible, I would request mediation briefs and any supporting documentation to be provided to me electronically at least 10 business days before the mediation. I am happy to work with the parties to best accommodate their needs. Depending on how much time I will be given before each mediation and if time allows, my mediation rate includes both pre-mediation consultation and review. Once all parties consent to mediation, a conflicts check will be conducted followed by a confirmation letter and invoice for fees depending on how much time is needed for mediation. If it is unclear at the outset how long mediation will last, the invoice will be provided after the mediation. If the parties opt to continue to use my services privately thereafter, an agreement to mediate and confidentiality agreement will be sent out for return signature prior to the private mediation date.
