Arbitration Approach:
I can easily switch back and forth from evaluative to facilitative as needed.  Often times I begin the day facilitative and will get more evaluative if settlement is eluding the parties. 
Briefs & Other:
A thorough brief of the law; settlement attempts up to this point, and obstacles to resolving the matter at mediation are good to know.

I do ask if something like potential bankruptcy stands in the way of settlement or limits settlement, that this is communicated prior to mediation so that if the other side wants to see financial records, etc. that can be provided.
