Arbitration Approach:
Studies show that the most successful mediators are those who develop a rapport with mediation participants, and the most satisfied parties are those who have prepared well for mediation. Susan strives to achieve these goals. Since mediator style is not the best predictor of successful mediations, she offers a 360-degree style in which she makes suggestions for mediation preparation, facilitates communication, and serves in a directive capacity as needed. Susan brings to the table patience, perseverance, perpetual optimism, and past experience since 1998. As an arbitrator, she applies a flexible approach and holds a pre-arbitration conference with attorneys to develop an arbitration process that meets the needs of the parties.
Briefs & Other:
Susan prefers short, general briefs to be submitted via e-mail to susan@susanexon.com at least 7 days before mediation. Briefs should include a description of the nature of the dispute, the names of the parties, the procedural status of the lawsuit, an outline of the legal and factual issues in dispute, and a summarization of settlement discussions to date. Susan strongly prefers that the actual parties and decision makers be present at the mediation, but with the stipulation of all parties, will accept availability of out-of-town decision makers by phone as long as they are actually available. Due to the COVID-19 pandemic, Susan prefers to conduct mediations and arbitrations via Zoom and is well versed with that online platform.
