My professional practice, and mediation style, has always emphasized client control, and open access to all available information which would promote settlement.  Babcock & Cappelli has represented a diverse business clientele in California emphasizing "preventative law"; the practice of seeking resolution short of litigation for our clients, minimizing both emotional and financial costs. I can assist in the evaluation of the matter if necessary; however, I prefer to have parties, and counsel, reach a collaborative settlement that best serves the clients.
Briefs & Other:
Briefs should include: statement of case, status of prior settlement negotiations, each party's legal position and substantiation/authorities, and each party's suggested resolution.
We will send mediation information and preparation documents prior to first meeting and may contact counsel - or unrepresented party(s) - in advance of first meeting to insure preparation for, and attendance by all necessary participants at mediation.
Fee Information:
$300 per hour
Rate per day: $1,600 (9:00 AM - 5:00 PM); Rate per half-day: $800 (9:00-1:00). Reduced rates considered; fees and costs - including travel are negotiable based upon case complexity.
Locations:
If all parties agree, I can accommodate mediations in Orange County at a mutually agreeable location.
