Arbitration Approach:
I try to adapt to parties' and counsels' preferences and needs appropriately, and prefer relative informality when it will not detract from the parties' trust and confidence in mediation as a process.  Neutrality and accessibility are vital, as is the necessity of maintaining the parties' trust and confidence in their representatives. I encourage confidential communications to the fullest extent possible, and hope for more than a recitation of the material facts in dispute, to enable me to understand the positions of the parties and the financial, legal, and even emotional factors which surround any dispute.  Mediation permits parties and counsel to create forms of remedies which may be far better tailored to the circumstances of their problem or dispute than those which might be available to them in trial or arbitration.  Thus, I believe a Mediator must demonstrate a willingness to understand the facts, circumstances, and the needs of the parties in each case, and combine that with the willingness to explore as many paths to resolution as is possible. Ex-parte communications are welcomed at all stages of mediation, before, during, and while a hearing may be in recess -- with the clear understanding that they are welcomed from all parties.. If agreement is reached by the parties, I insist on execution of documentation sufficient to make it enforceable.
Briefs & Other:
While not mandatory, I believe that written Mediation Statements or Briefs are of great value to the Mediator, particularly where they provide suggested means of resolution based on counsel's understanding of the parties' needs.  Further, I believe they may be of even greater value to counsel: by focusing on potential resolution of the matter and presenting the facts and legal theories which support their position in the  negotiation, they are free to focus on a goal and result over which they and their clients have control, rather than an arbitrator, judge, or jury deciding their fate.
Fee Information:
$300 per hour
Rate per day:$1,500. Rate per half-day: $800. Travel expenses: None in mandatory, court-ordered mediations; to be set on a case-by-case basis in Private Mediations.

Locations:
Western Region (Riverside, Corona, Moreno Valley); Mid-County Region (Temecula, Hemet, Banning); Hearings/Proceedings may be held in Riverside or at other locations at request of the parties.
