Most of my work currently is transactional, such as counsel for start-up companies performing services normally associated with founding and financing development stage and early stage companies. Arbitration Approach:
In Mediations, I follow the Straus Institute's STAR methodology, usually contacting counsel prior to a mediation to assess case needs and discuss briefs, decision makers, and document management, including settlement documents. IN mediation I use both joint sessions and caucuses to develop issues and potential solutions. With counsel's permission, I engage the principals in the discussions and review of any settlement agreement. I expect any settlement to be memorized in writing. 

In Arbitrations, I follow AAA or JAMS rules, using pre hearing conferences to establish procedures, deal with discovery issues and documentary evidence. I would expect briefs from counsel in most matters, expect limited jurisdiction matters.
