As a neutral party trying to resolve a dispute, I try to keep the participants in mediation thinking objectively and try to educate them on cognitive biases (anchoring, confirmation bias, reactive devaluation, risk aversion, loss aversion, etc.) using plain language. I also try to find a way, if possible, to create value. This approach has been called “making the pie bigger before dividing it up.”
I would like to be provided with standard mediation briefs in advance of mediation. For medical malpractice matters, I would like to see any nonconfidential written expert opinions.
